Grey belt Appeal success at Brook Farm, Daws Heath

The Appeal has been allowed for 173 new homes at Brook Farm, Daws Heath in one of the first grey belt decisions for major development; you can read the Inspector’s decision here APP/M1520/W/24/3351658. 

Paul Gibbs of DJA provided landscape and Green Belt / grey belt evidence. We successfully argued that Daws Heath is a village and that the site should be considered to be grey belt.

The Inspector noted that “villages should not be considered large built up areas”, that “given that Daws Heath is a village, the appeal site cannot contribute strongly to Green Belt purpose b)” . He concluded that the site is grey belt and therefore “the proposal would not be inappropriate development within the Green Belt.“
